Information about ICE Raids impacting Central Americans with deportation orders/Información sobre las redadas de ICE que impactan a Centroamericanos que tienen órdenes de deportación

With the recent news of the Obama administration’s plan to conduct more Immigration and Customs Enforcement (ICE) operations in the near future, South Carolina Appleseed Legal Justice Center wants to remind immigrants and their allies of the following points:

  • One is only at risk of being picked up by ICE if they either a) missed their immigration court date or b) if they already have an existing order of deportation.
  • If someone is picked up by ICE, they have the right to remain silent, and should request to contact their immigration attorney immediately.
  • If one is at risk of being deported or being picked up by ICE, they should make sure they have a plan for their children. This means making sure the children know where to go if mom or dad is picked up, how they’re getting to school the next day, and that all prescriptions, identifications, and passports are up to date.
  • Make sure the emergency contact is listed as someone authorized to pick the children up from school. If no authorized person comes to pick the child up, the school has to call state authorities.
  • Make sure to have an immigration attorney’s phone number on hand at all times if you are at risk of being deported.
  • DETAINED IMMIGRANTS SHOULD NOT SIGN ANYTHING THAT THEY DO NOT UNDERSTAND
  • DETAINED IMMIGRANTS SHOULD NOT SIGN ANYTHING WITHOUT A LAWYER PRESENT.

South Carolina Appleseed would like to emphasize that ICE is not looking for everyone. They are looking ONLY for those who have already received an order of deportation. If an immigrant has MISSED his or her immigration court date, it is very likely that they have an order of deportation. These people should speak to an immigration attorney immediately.

El presidente Obama acabo de anunciar un plan de empezar más operaciones de ICE en el futuro cercano.  Nosotros aquí en el Centro de Justicia Legal Appleseed de Carolina del Sur queremos informar a los inmigrantes que nos siguen de unas cosas:

  • Las únicas personas que tienen el riesgo de ser detenido por ICE son las que ya tienen un orden de deportación y las que no fueron a la corte.
  • Si ICE recoge a un inmigrante, esta persona tiene el derecho de quedarse en silencio. El inmigrante también debe pedir contactar su abogado inmediatamente.
  • Si alguien tiene el riesgo de ser deportado o es posible que ICE le puede recoger, debe asegurarse de que tiene un plan de emergencia para sus niños. Este significa que los niños saben cómo van a ir a la escuela, donde van en caso de que uno de sus padres es arrestado, y que todas sus prescripciones, identificaciones, y pasaportes no han vencidos.
  • Asegúrese de que esta persona está en la lista para recoger los niños de la escuela. Si ninguna persona autorizada viene a recoger los niños, la escuela tiene que llamar a las autoridades estatales.
  • Si alguien tiene la posibilidad de ser deportado, siempre debe tener a mano el número de teléfono de un abogado de inmigración.
  • INMIGRANTES DETENIDOS NUNCA DEBEN FIRMAR ALGO QUE NO ENTIENDAN.
  • INMIGRANTES DETENIDOS NUNCA DEBEN FIRMAR ALGO SIN UN ABOGADO PRESENTE.

Queremos enfatizar que el ICE no está buscando todos los inmigrantes indocumentados. Ellos SOLO están buscando los que ya tienen un orden de deportación. Si un inmigrante ha PERDIDO su fecha de corte de inmigración, es muy probable que tiene orden de deportación. Estas personas deben contactar un abogado de inmigración inmediatamente.
